Welcome to DivineEpic. These Terms and Conditions (“Agreement” or “Terms”) outline the rules, responsibilities, and legal understanding between DivineEpic and its users, including independent artists, music labels, and sub-distributors.

By accessing our website or using our services, you confirm that you have read, understood, and agreed to be legally bound by these Terms.

1. Company Overview – Who We Are

DivineEpic is a third-party audio distribution service provider, helping independent artists, music labels, and sub-distributors distribute their content (songs, albums, instrumentals, etc.) to major digital streaming platforms like Spotify, Apple Music, Amazon Music, YouTube Music, JioSaavn, and more.

Important Note:
DivineEpic is not directly affiliated with any streaming platform. We operate via a white-label distribution system, powered by a licensed third-party distributor (referred to as “Third-Party Distributor”).

All deliveries, technical infrastructure, royalty payments, and content management are handled through this upstream distributor.

2. Third-Party Partnership

To offer digital music distribution services, DivineEpic uses the platform and services of a Third-Party Distributor, who handles:

  • Direct ingestion to DSPs (streaming platforms)

  • Metadata & catalog management

  • Royalty tracking and payouts

  • YouTube Content ID registration

  • Copyright flagging and takedown processing

What This Means:

  • DivineEpic acts as a service intermediary, not a direct partner of any streaming platform.

  • All users must comply with both DivineEpic’s policies and the guidelines of our upstream distributor.

  • Payments, analytics, and delivery timelines are dependent on the Third-Party Distributor’s systems and schedules.

3. Master Level Service

We now offer a Master Level plan that provides additional tools, features, and services for advanced users.

Fee Structure:

  • One-time fee of ₹3,999 INR

  • Grants access to advanced tools, premium release features, and fast-track support

Eligibility:

  • Open to independent artists, record labels, or sub-distributors

  • Voluntary participation upon payment

  • Once payment is made and account activated, users will not be eligible for refunds under any circumstances

4. Refund Policy

DivineEpic follows a strict no-refund policy for all services, including Master Level subscriptions.

By proceeding with payment, you agree that:

  • You have read and understood the Refund Policy

  • You voluntarily choose to join the service

  • No refunds will be issued under any conditions, including dissatisfaction, change of mind, or platform delays

  • All questions and clarifications must be made before joining

No exceptions will be made once the payment is processed and account is created.

5. Use of Dashboard

All content submission, metadata management, and royalty reporting are facilitated via a third-party dashboard.

Key Points:

  • DivineEpic does not own or control the dashboard system

  • All technical functionality is provided by the Third-Party Distributor

  • Any downtime, delays, or limitations in reporting or content delivery fall under their infrastructure

  • DivineEpic provides onboarding and support, but holds no liability for third-party system issues

6. Scope of Services

Through the white-label platform, DivineEpic provides:

  • Audio distribution to major streaming services

  • Royalty tracking and dashboard access

  • White-label accounts for sub-distributors and labels

  • Metadata control and scheduling

  • YouTube Content ID monetization (if applicable)

  • Release management, onboarding, and support

7. Content Submission & Processing Policy

Release Processing Time:

  • 5–7 business days on average

  • Subject to platform approval, national holidays, or technical delays

Original Content Requirement:

  • Only original content is accepted

  • Cover songs, remakes, or licensed third-party content must be accompanied by valid licenses or permission letters

Violation may result in:

  • Immediate rejection of the content

  • Account suspension

  • Permanent removal from platforms

8. Copyright & Legal Responsibility

User Accountability:

By submitting content, you confirm that:

  • You own or have licensed distribution rights

  • You will not upload pirated, stolen, or unlicensed material

  • You are legally and financially responsible for any copyright claims

DivineEpic’s Liability:

  • DivineEpic does not hold or claim any copyright ownership

  • We are not responsible for takedowns, strikes, or financial claims

  • Failure to provide valid proof within 15 days may lead to:

    • Account suspension

    • Content removal

    • Earnings being withheld permanently

9. Sub-Distributors

If you act as a sub-distributor:

  • You are responsible for verifying the legality of your users’ content

  • If a user violates copyright:

    • Only their content/account will be penalized

    • Your account will remain unaffected unless you are directly involved

    • You are required to assist in resolving the matter

10. Payments & Reports

All earnings are collected, processed, and disbursed by the Third-Party Distributor. DivineEpic only releases payments after receiving funds and official reports.

Payment Timeline:

  • First payment may take 5–6 months post-release

  • Future reports follow a monthly or quarterly schedule

No earnings will be processed or paid until DivineEpic receives final clearance and reports from the upstream distributor.

We do not guarantee fixed dates or amounts in advance.

11. Account Termination & Content Takedown

DivineEpic reserves the right to:

  • Suspend or ban any user violating these Terms

  • Remove content triggering copyright violations

  • Withhold payments in case of disputes

  • Decline releases without explanation if they violate internal or distributor policies

12. Indemnification

By using DivineEpic services, you agree to:

  • Indemnify DivineEpic and its affiliates from any legal actions, damages, or claims related to your content

  • Accept full legal and financial responsibility for all content uploaded through our system

13. Changes to These Terms

DivineEpic may modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date.

Continued use of our services implies acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, with jurisdiction located in the courts of West Bengal.
