User & Digital Music Distribution Service Agreement

1. Purpose and scope

This User & Digital Music Distribution Service Agreement governs registration for and use of DivineEpic Music’s music distribution and related services. It covers account administration, distribution services, rights management, monetization, reporting, payments, compliance and takedown administration.

2. Separate release-specific agreement

This agreement is a general account and service agreement. It does not, by itself, grant DivineEpic Music a distribution licence for any particular recording. The User must separately review and electronically accept a Release-Specific Digital Music Distribution License for each release submitted. The two agreements operate together.

3. Rights and user responsibility

The User represents that they own, lawfully control, or have obtained all rights, permissions, licences and consents required for every recording, composition, artwork, sample, name, metadata entry and other material submitted. The User is responsible for the accuracy and legality of submissions and must provide reasonable supporting documentation when requested.

4. Services and third-party platforms

Depending on availability and eligibility, services may include digital music distribution, YouTube Content ID and rights management, YouTube UGC services, Meta/Facebook/Instagram rights management, CRBT/Caller Tune, monetization and analytics. Delivery may involve authorized distributors, aggregators, DSPs, payment providers and other operational partners. Platform acceptance, availability, territory coverage, processing and monetization are controlled by the relevant third party and are not guaranteed.

5. Ownership and conflicting distribution

Using the services does not transfer ownership of master recordings, sound recordings, compositions or copyrights to DivineEpic Music. The User must not knowingly authorize another provider to distribute or manage the same release in a way that creates conflicting delivery, monetization, Content ID, UGC or rights-management claims while the applicable release is managed through DivineEpic Music.

6. Prohibited activity and compliance

• Artificial or manipulated streams, views, clicks, downloads or engagement, including bots and click farms.
• Unauthorized recordings, compositions, artwork, samples or other third-party content; false ownership declarations; impersonation or misleading metadata.
• Unauthorized Content ID, UGC, copyright or monetization claims, and manipulation of platform algorithms, reporting or revenue attribution.
• Conduct likely to cause platform penalties, claims, chargebacks, revenue reversals or material losses.

7. Rights verification and enforcement

Where a rights or compliance concern reasonably arises, DivineEpic Music may request evidence of ownership, licence or authorization and may provide a reasonable response period, commonly 48–72 hours where appropriate. Releases or services may be held, restricted, rejected or removed where reasonably necessary. Immediate protective action may be taken where there is a material risk of infringement, fraud or platform enforcement.

8. Takedowns and account restrictions

A User may submit a formal takedown request through the applicable process. Once a valid request is verified, DivineEpic Music will initiate the relevant third-party removal process. Removal may take approximately 15–20 days after initiation, depending on third-party processing; this is an estimate, not a guaranteed deadline. Accounts or services may be suspended or terminated for material or repeated violations, subject to applicable law and relevant third-party terms.

9. Reporting, revenue share and payments

Reports are made available after the relevant information is received from the applicable DSP, platform, distributor, aggregator or service provider. Payment timing and available methods depend on received reports, verification and third-party processing. The applicable revenue share or commission is determined by the User’s plan or separate commercial arrangement. Any payout threshold, currency, withdrawal method or processing period shown in the account or applicable plan forms part of the applicable payment terms.

10. Identity verification and privacy

DivineEpic Music may request identity, rights, payment or other supporting documentation reasonably needed for account verification, service delivery, fraud prevention or compliance. Information is handled according to the Privacy Policy and applicable data-protection requirements.

11. Liability, indemnity and third-party decisions

To the extent permitted by applicable law, the User is responsible for claims arising from their breach, unauthorized content, infringement, false declarations or prohibited activity. DivineEpic Music does not guarantee acceptance, publication, continued availability, monetization, revenue amounts or specific processing times on third-party platforms. Nothing in this agreement excludes liability where such exclusion is prohibited by law.

12. Governing law and disputes

This agreement is governed by the laws applicable in India, subject to mandatory legal requirements. The parties will first attempt in good faith to resolve disputes through written communication. Any further dispute-resolution process will be as separately agreed or required by applicable law.

13. Electronic acceptance and changes

By accepting this agreement electronically during account registration, the User confirms that they have read and understood it and accept responsibility for the information, content, rights and activity submitted through their account. DivineEpic Music may update general service or compliance terms where reasonably necessary and will communicate material changes through the website, account or another reasonable method.
